Borrower's Agreement.


Members agree to the following terms when they borrow from Ilkley Thingery. 

  1. To borrow items from Ilkley Thingery, you MUST be registered as a Member of Ilkley Thingery, or live at the address registered for a valid membership account. Members must be aged 18 or over. You cannot Borrow Things on a friend's or family member's account if you do not live with them. 
  1. Prior to borrowing items, all Members must (a) show proof of their address and identity at Ilkley Thingery to the manager of or a volunteer at Ilkley Thingery, (b) have their residence confirmed at Ilkley Thingery, by a volunteer at or manager of Ilkley Thingery, and (c) accept the Borrowing Agreement, Waiver and Indemnity.  To allow borrowing on your membership account, you MUST show proof of your address and identity to the project manager or a current volunteer at Ilkley Thingery. 
  1. Members CANNOT lend out items they have borrowed from Ilkley Thingery to other people UNLESS they get permission from the manager of Ilkley Thingery (Erika Shilling) to do so. If you send someone to collect Things that you have reserved on your account, the person collecting MUST bring proof that they are collecting the Thing(s) on your behalf, or that they share your address. If no proof is shown that the reserved Thing(s) are being collected for you, or for use by your household, Ilkley Thingery reserve the right to refuse to issue those Things through your account.  
  1. Members will be asked to make a payment to borrow an item, in line with the stated rate for borrowing that item.
  1. All items borrowed  from Ilkley Thingery must be returned to Ilkley Thingery on or before their due Return Date. The return date will be agreed by the borrower and the Ilkley Thingery.
  1. Members may extend their loan of an item they have borrowed (by logging in to their account, or telephoning the Thingery during opening hours or emailing library-of-things@climateactionilkley.org.uk to request an extension) if the item has not already been reserved by another Member. Ilkley Thingery reserves the right to refuse or limit renewals.
  1. Ilkley Thingery reserves the right to refuse the loan of any item at its discretion.
  1. The manager of or volunteers at Ilkley Thingery might be able to explain how Things in the Thingery library work. However, when you borrow an item from Ilkley Thingery you are responsible for understanding how to use or learning how to use that item, and for use of that item, you are agreeing that you are capable of using the item in a safe and proper manner, and that you WILL use the item in a safe and proper manner.
  1. Ilkley Thingery will only be liable to you for loss or damage caused by our negligence, or for failing to tell you about a known fault in any of the Things provided through Ilkley Thingery. Ilkley Thingery will not be liable for faults of which we are not aware, or for the carelessness, lack of due attention, negligence, wilful damage, or lack of knowledge or skill of our members. Please see the liability waiver below. 
    NOTE: As we are not a Hire Company, the risk to you in borrowing from us is greater than if you were to buy or hire an item from a commercial concern.
  1. The Member agrees that Ilkley Thingery is not responsible for any manufacturing defects, design faults or flaws in quality of workmanship or materials inherent in any borrowed items. Each time you take an item out you must check it visually before you take it, and make other checks for any faults that you may be able to identify before using it. The member agrees that IF any borrowed item becomes unsafe OR in a state of disrepair whilst in the member’s possession, he or she MUST DISCONTINUE USE of the item IMMEDIATELY, and notify Ilkley Thingery of any faults or damage upon return of that item to Ilkley Thingery.
  1. ALL electrical Things in the Ilkley Thingery library are PAT tested BEFORE they enter the library; they are also PAT tested AFTER being returned to Ilkley Thingery after EVERY borrow. If you borrow electrical equipment you must check the visible wires and plug for any damage before using it. If you use an item outside, move it about, or use it in circumstances where it may encounter water, or anything sharp or other electrical wiring, you MUST use a circuit breaker.
  1. Some of our items are on temporary loan to us from Ilkley residents. If you reserve an item to borrow that is on temporary loan to  Ilkley Thingery, you may have your reservation cancelled if the person lending it to us removes the item from our library.
  1. The borrower MUST take reasonable care of the item. All items are to be returned in the SAME (or Better) condition than they were issued in, barring normal wear and tear.  Ilkley Thingery may charge the member to cover the cost of cleaning, if an item is not returned in a clean state. The Member agrees to a) pay for the loss of or damage to any item they have borrowed if the loss or damage is the result of carelessness, negligence or misuse, b) accept Ilkley Thingery’s assessment of the condition of items, c) accept Ilkley Thingery’s assessment of fair restitution for dirtiness, intentional damage, carelessness, and or loss of items in part or in total. This restitution amount will be no more than the full replacement cost of the item.
  1. if an item is damaged when you are using it or when you have it on loan, you MUST report the damage when returning it, even if the item appears to be functioning normally. If you are found to have knowingly not reported such damage you may be refused service in future or fined for the damage/ cost of replacement or repair.
  1. Some things require consumable parts (e.g. sanders have sanding pads, jigsaws have blades, etc). Please note they are not guaranteed to come with the Things in our library. You may have to buy your own blades, sanding pads, etc. If they are provided, you should bear in mind that these consumable parts come at a cost, and should you use them, you should either replace them, or cover their cost. 
  1. If a thing is returned late, you may be charged a late fee. This reflects the disruption that late returns can cause to the Thingery, and to other members with reservations for the item. Other people are relying on you to return Things, so please be considerate. This late fee will be £5 per day per thing for every day an item is overdue until the item is returned. Late fees are capped at the full replacement cost of the thing borrowed. Late fees MUST be paid in full before borrowing further items. Ilkley Thingery may replace severely late things in our library and hold the Member responsible for the full replacement cost. Fines must be paid in full before borrowing further items.
  1. The Member agrees to supplying us with a supported method of payment so that we can charge them for membership fees, borrowing items and other pre-agreed transactions. We do not store payment details on our systems. They are securely stored on the systems of our payment processor, Stripe. Stripe has been audited by a PCI-certified auditor and is certified to PCI Service Provider Level 1. This is the most stringent level of certification available in the payments industry.

IN SHORT

  • Return Things Clean, on the day they are due back, to the place you picked them up from, during opening hours. Do Not attempt to repair our Things unless you have permission from the manager to do so. Use common sense when using Things, Do not damage Things, do treat our Things with care, and do tell us about any problems you encounter.

I have read and fully understand the Borrowing Agreement of Ilkley Thingery, and I understand that failure to comply with any part of this may result in cancellation of my borrowing privileges and/or legal action against me. I relinquish any and all claims against Ilkley Thingery.

Waiver and Indemnity

Our Statement:

The Equipment in our collection is for the use of Ilkley Thingery Members. Out of respect for future users, please take care of the Equipment you borrow and report any damage to Ilkley Thingery immediately.  Borrowers are responsible for damage to items they have borrowed  that results from carelessness, intentional actions or negligence; we will not charge you for damage that occurs through no fault of your own. If you feel compelled to return items in better condition than when you borrowed them, that would be greatly appreciated.

Your Statements:

‼️ READ THIS CAREFULLY, AS YOU AGREE TO IT EVERY TIME YOU BORROW 

  • I am capable of using the Equipment I am borrowing, and I will use the Equipment I am borrowing in a proper manner. I am aware that Ilkley Thingery, its partners, directors, officers, members, volunteers and employees claim no expertise and make no representation concerning the fitness of any Equipment for any particular use (NB. all electrical items are PAT tested between each borrow).
  • I do hereby for myself, on behalf of my successors and assigns, waive any and all claims against Ilkley Thingery, its officers, agents, employees and volunteers for any injury or injuries of any nature that I may suffer or incur in the use of the Equipment that I am borrowing from Ilkley Thingery except those caused by a defect known to Ilkley Thingery and not made known to me.
  • I agree to release and indemnify and hold harmless Ilkley Thingery, its officers, agents, employees and volunteers from any and all liability, loss, claims, demands, actions or causes of action for the death or injury to any persons, and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from the use of Equipment that I am borrowing from Ilkley Thingery.

I have read and fully understand the rules and regulations of Ilkley Thingery, and I understand that failure to comply with any of these conditions may result in the revocation of my borrowing privileges and/or legal action against me.
